What the 0.4 mg threshold does—and does not—answer

The enacted statute is scheduled to exclude a final hemp-derived cannabinoid product that exceeds 0.4 milligrams combined total per container of total tetrahydrocannabinols, including THCA, and other cannabinoids determined to have, or marketed as having, similar effects. For a canned beverage, the can is the relevant container under the statute.

A concept designed around that threshold still needs formula-specific work. The cannabinoid source, all relevant cannabinoids in the finished product, total-THC testing, state law, labeling, sales channel, and qualified legal review all matter.
